What sort of things should I look out for in terms of the legal side? This isn't something I just want to go buy a domain, hosting, and auction software, and start going is it?

Just some basic things to look out for would be fine, don't have to go into great detail.. Just trying to get a general idea.

This is one of those things you should probably talk with a lawyer about. The terms of service will depend on how much liability you are willing to accept, how much you can deny, etc, etc, etc. Also, there's a LOT of competition out there.
